The blog this week is based around buying a second hand Volvo or Toyota at an auction.
When buying a Volvo or Toyota from a specific car auction website using the ‘Buy Now’ option, if available, is not deemed an auction purchase.
If you purchase in this way then your consumer rights – including distance selling rights – apply – providing you are purchasing the Volvo or Toyota
from a legitimate business trader. When purchasing a Volvo or Toyota at an online auction your legal rights depend on whether the seller is a private
individual or a car dealer. If the seller is a private individual, the car only needs to be as described – so it’s a case of ‘buyer beware’.
Your legal rights are the same as if you were buying from them in person. There can be all sorts of problems associated with purchasing a Volvo or
Toyota via an online auction site – if at all possible you really must try and view the car in person. So do your homework and always check to see
if the seller is a private seller or a dealer therefore you will know what your consumer rights are should there be a problem with the vehicle. If
the seller is a dealer, you’ll be protected by the Sale of Goods Act if you find that the car isn’t of satisfactory quality, fit for purpose or as
described. You will also be covered byConsumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, which means you are entitled
to cancel the order within 14 days of the original purchase.

However if you purchase a Volvo or Toyota (or any vehicle for that matter) during a live auction you may find that you do not have any rights whatsoever
under the 2015 Consumer Rights Act. The cars are usually ‘sold as seen’ so be sure to thoroughly check the terms and conditions of the particular auction
house you are visiting and check over the vehicle you are buying. Try not to get carried away with the whole bidding thing. Once you have placed a
bid you cannot retract it. So if you think you may be in danger of getting carried away take someone with you to bid on your behalf and always agree
the top price you are willing to go to and stick to it. Or you may find you end up paying way more than the car is worth if you get in a bidding war
with someone else who really likes the car you want.
